In my essay I will tell you the various kinds of drinking and driving offences, the penalties, and the defences you can make if you are caught drinking and driving. Let me tell you about the different offences. There are six offences in drinking and driving. They are "driving while impaired", "Having care and control of a vehicle while impaired", "Driving while exceeding 80 m.g.", "Having care and control of a vehicle while exceeding 80 m.g.", "Refusing to give a breath sample", and "refusing to submit to a roadside screen test. These are all Criminal Code Offences. Now lets talk about the penalties of drinking and driving. The sentence for "refusing to give a breath sample" is usually higher than either of the "exceeding 80 m.g." offences. Consequently it is usually easier in the long run for you to give a breath sample if asked. If, for example you are convicted of "Refusing ato give a breath sample" for the first time, but was earlier convicted of "Driving while impaired", your co nviction for "Refusing" will count as a second conviction, not a first, and will receive the stiffer penalty for second offences. For the first offence here is the penalty and the defences you can make. Driving a vehicle while your ability to drive is impaired by alcohol or drugs is one of the offences. Evidence of your condition can be used to convict you. This can include evidence of your general conduct, speech, ability to walk a straight line or pick up objects. The penalty of the first offences is a fine of $50.00 to $2000.00 and/or imprisonment of up to six months, and automatic suspension of licence for 3 months. The second offence penalty is imprisonment for 14 days to 1 year and automatic suspen- sion of licence for 6 months. The third offence penalty is imprisonment 2 for 3 months to 2 years (or more) and automatic suspension of licence for six months. These penalties are the same for the following offences. "Having Care and Control of a Motor Vehicle while Impaired" is an other offence. Having care and control of a vehicle does not require that you be driving it. Occupying the driver's seat, even if you did not have the keys, is sufficient. Walking towards the car with the keys could be suffi- cient. Some defences are you were not impaired, or you did not have care and control because you were not in the driver's seat, did not have the keys, etc.

Performance Appraisal is a formal management system that provides for the evaluation of the quality of an individual’s performance in an organization, and is usually prepared by the employee’s immediate supervisor, and the procedure typically requires the supervisor to fill out a standardized assessment form that evaluates the individual on several different dimensions and then discusses the result of the evaluation to the employee (Grote, 2002). According to Grote, too often, performance appraisal is seen merely as a once-a-year drill mandated by the personnel department, but in organizations that take performance appraisal seriously and use the system well, it is used as an ongoing process and not merely as an annual event. To obtain the best information possible if performance appraisal data must be used, four phase model of performance appraisal must be used, and these are through, performance planning, performance execution, and performance review. In performance planning, this is usually set at the beginning of the year, the manager and individual get together for a performance-planning meeting in which they discuss what a person will achieve over the next 12 months. In the performance execution, the manager provides coaching and feedback to the individuals to increase the probability of success and creates the condition that motivate and resolves any performance problems that arise and in the midway through the year, they meet to review the individual’s performance thus far against the plans and goals that they discussed in the performance planning meeting (Grote, 2002). In performance assessment, the manager reflects on how well the subordinate has performed over the course of the year, assembles the various forms of paperwork that the organization provides to make this assessment, and fills them out, and the manager also recommend a change in individual’s compensation based on the quality of the individuals work (Grote, 2002). The completed assessment form is then reviewed and approved by the appraiser’s boss, department head, or the compensation manager. In performance review, the manager and the subordinate meet, usually about an hour, and they review the appraisal form that the manager has written and talked about how well the person performed over the past 12 months, and at the end of the review meeting, they set a date to meet again to hold a performance-planning discussion for the next 12 months, at which point the performance management process anew (Grote, 2002). Self-ratings fit to this approach in the way that, it is needed by the manager in the performance assessment to be able to fully evaluate the employee.

Lies in Huck Finn Essay

â€Å"That book was written by Mr. Mark Twain, and he told the truth, mainly. There as things which he stretched but mainly he told the truth† (1). These are the first lines and the first lies in The Adventures of Huckleberry Finn, so from the beginning, the lack of truth is a major theme in the novel. Mark Twain justified the lying in different levels. Some of the lies are vicious and self-serving and these lies were mostly told by the King and Duke while other lies were childish and harmless which was mostly told by Jim. The â€Å"bad† characters in the novel tended to spew out lies on a daily basis. The king and Duke tell lies without pausing and transform lying into an art form. They are automatically dubbed villains for their lies because unlike Huck, they tell their lies for self-gain. They are ruthless men who will do practically anything to get what they want. They make up fraudulent names in order to get special treatment from Huck and Jim and lower them to slaves. The Duke claims he is a descendant of the â€Å"Duke of Bridgewater† (100). When the king hears this, he decides he too would take the same path as the Duke so he can be treated as royalty as well, so he spins his own tale that he is the long lost King of France, â€Å"Dauphin. They lied to escape work and although Jim believes them, Huck just goes along with it so he would not anger them. In addition to this, they also deceive numerous towns with their faux imitation of â€Å"The Royal Nonesuch† for financial gain. Their lies sped past the road of immorality to downright evil when they lied to two girl who recently lost their uncle in order to steal their money and leave the two girls broke and without a house or a family. The king and the Duke lie only for the satisfaction of appeasing their materialistic desires. Although the Duke and King lied for their own greedy satisfaction, Jim lied harmlessly. After Tom and Huck played a prank on him, Jim lies to all the other slaves about how he hat got take from his head and put on a tree branch when he was asleep. He tells them a fabricated story of spirits visiting him and achieves celebrity status among the slaves. He also tells them about his hairball which can supposedly tell the future, although only he can tell what it is saying and the customer must pay Jim first for it to work. Even though his lies are self-serving, unlike the Duke and King’s, they harm no one. Mark Twain painted the art of lying in two different lights in this novel. In one light, it is evil and self-serving and whoever uses it is considered a vile villain, while in the other light, it is deceitful and sly and whoever uses it is considered a child who does not know wrong or right. He proves that there is no black and white: lying is bad or good. Lying can be innocent, and lying can be dangerous; it depends who you are and how you decide to use it.

Once Upon A Family Essay

In the book (Daley, 2007) â€Å"Once Upon A Family† by author Margaret Daley, we read about a character by the name of Sean Williams who is helped by his principal at Cimarron High, where he attends school, by the name of Peter Stone. Laura Williams was extremely nervous as she stands before the high school principal, who is tall, dark and handsome, as she worries so much for her oldest child who had always been a good student. Peter Stone explains that Sean wasn’t willing to talk very much about the fight that he took part in and wonders if the new move had anything to do with this sudden change in Sean’s behavior. Peter takes a special interest in Sean’s mother and realizes that he can help her, her family and himself in finding completeness in their lives. Peter Stone lives on a beautiful ranch and is a religious man who learns not only to care for Sean, but also for his mother; Laura and Sean’s siblings. The Williams family attend Peter’s church many times and learn that God has special intentions for their lives and also that all problems can be solved through prayer. Laura Williams is a good hearted, self-sacrificing widow, while Peter Stone worked at his job at the high school where he could make a difference in the lives of the young and attended church, faithfully to fulfill his religious needs, but he still needed the Williams family in his life to fill an empty void and just as desperately as they needed him. We learn from this book that God has a special way of bringing people together and he always knows exactly what we need.

Tanzimat

Reform program in the Ottoman Empire from 1839 until 1876. Tanzimat is Turkish for â€Å"reorganization†, and was a program that based itself on the changes started by sultan Mahmud 2. The actual program was started under sultan Abdulmecid 1, and corrupted and destroyed by sultan Abulaziz. The Tanzimat program was one of highest importance to the Ottoman Empire. It was initiated by reformists who understood why the empire was growing weaker while neighbour countries were growing stronger. The situation was clearly illustrated by numerous military defeats.Inside the empire also, there were many dangerous tensions that could lead to conflicts and demands of autonomy. This had already happened in Egypt, when Muhammad Ali achieved autonomy. But high in the empire there were many people with conservative ideas, as well as many who (accurately) feared for their own positions, and who opposed the reform processes. One characteristic of the Tanzimat that made it hard to accept for man y, was that it had been formed upon European ideas and ideals.And Europe was considered the lands of the infidels. The reforms of the Tanzimat was administered under the Grand Vizier. The most known of the Tanzimat viziers was Mustafa Resid Pasha, who served altogether 6 terms. While the Tanzimat program might have saved the Ottoman Empire, or at least prolonged its existence, one may assert that it came too late. But even more grave, it was discontinued by sultan Abdulaziz' abuse of politics and little respect for the reforms.And there was even less hope for the reforms when Abdulhamid 2 ascended the sultan throne in 1876, and as among the first of many despotic acts stopped the Tanzimat. The program The program was defined in a document of 1839 called Hatt-i Serif (Noble Edict of the Rose Chamber). It contained new regulations in several fields: New administration: Provincial representative assemblies (nothing to do with democracy in modern terms, of course) were established, toge ther with state courts that ruled independent of the religiously learned.But more important than that, the local administrations started to function as parts of large state structure. Also, new codes of commercial and criminal law were introduced. Standardized system of taxation: Earlier there had been abuses in many provinces, allowing local rulers to enrich themselves on the locals. The system of taxation also applied to military conscription and training, a system that now was regulated, and involved less pressure on the locals. New conscript system: The Ottoman Empire now introduced a conscript system based upon Prussian patterns.This involved the total end of the devsirme system, from which the Janissaries had been recruited. Rights of the individual: No matter what race or religion a citizen had, his or her security of life, property and honour was guaranteed inside the empire. In return, the state demanded that all citizens were loyal to the sultan and the Ottoman administrat ion. Secular school system: Earlier, Islam had been the foundation for schooling. Thus although Rwanda has received a massive infusion of foreign aid this has disproportionately benefited the elite Tutsis. On the positive side, Rwanda is the only country in sub-Saharan Africa on track to meet all health-related UN goals including reducing under5 mortality by two thirds. Also since 1994 per capita income has almost tripled and GDP quadrupled. ( Farmer 2013) However, these positive statistics hide significant disparities in ethnic aid beneficiaries. More than half of the aid received is distributed through Tutsi dominated government institutions so that it benefits mostly already comparatively better off Tutsis rather than the impoverished Hutus ( Farmer 2013)) Thus even though statistics indicate overall per capita income and GDP have risen rural Hutus who make up 84% of the population remain impoverished, (Endless and Hakizimana 2009).
